Terms and Conditions
- General
- The following terms and conditions apply to all contracts concluded via the online shop of Quality First GmbH, Werner-von-Siemens-Straße 8, 25337 Elmshorn, Germany (hereinafter: SELLER) under the domain www.morenutrition.de with the customer (hereinafter: CUSTOMER). The SELLER's contact details are:

- The seller does not accept any differing terms and conditions of the customer. This also applies if the seller does not expressly object to their inclusion.
- The term CUSTOMER refers exclusively to consumers. A consumer is any natural person who places an order for purposes that are neither related to their commercial nor their independent professional activity.
- The contract language is German. If the contract text is translated into another language, the German contract text remains binding.
- Ordering process and contract conclusion
- The presentation of the products in the SELLER'S online shop merely constitutes a non-binding invitation to the CUSTOMER to place an order.
- The customer can add the desired items to the shopping cart by clicking the corresponding button and initiate the order process by clicking on the shopping cart. During the order process, the customer must enter the necessary contact information for shipping and payment. It is also possible to create a customer account and save the entered order data for future orders.
- Input errors, especially items mistakenly placed in the shopping cart, can be corrected by the customer by entering the desired quantity in the shopping cart and using the available buttons. During the ordering process, the customer can correct input errors in the various steps by navigating to the respective step using the browser's "back" and "forward" buttons.
- By clicking the "Buy Now" button, the CUSTOMER submits a binding offer to conclude a purchase agreement for the items in the shopping cart. The SELLER will immediately confirm receipt of the order automatically via email. This automated order confirmation from the shop system does not yet constitute a contract. A contract is only formed when the SELLER accepts the CUSTOMER's offer by delivering the ordered items to the CUSTOMER, whereby the receipt of the goods by the CUSTOMER is decisive. The purchase agreement with the SELLER is only concluded upon this separate declaration of acceptance.
- If an external payment provider is selected among the payment options, the customer will be redirected to and the purchase completed on their website.
- If the CUSTOMER selects payment methods such as PayPal, credit card, Shop Pay, Apple Pay, Google Pay, Klarna, iDeal (NL), eps (AT), or other payment options where the account is debited immediately, the SELLER implicitly accepts the contract offer by offering this payment option at the end of the ordering process. If delivery of the goods ordered by the CUSTOMER is not possible through no fault of the SELLER, the SELLER reserves the right to withdraw from the contract concluded with the CUSTOMER. Delivery is particularly impossible if the SELLER is not supplied by its own suppliers through no fault of its own, or if the availability of a product explicitly refers to the SELLER's stock, which is already sold out at the time of the conclusion of the contract. The SELLER will inform the CUSTOMER of the exercise of the right of withdrawal without undue delay and will promptly refund any payments already received.
- Orders exceeding quantities typical for private consumption may be rejected or canceled. The customer will be notified accordingly.
- By completing the order, the CUSTOMER declares that he/she has read and understood the terms and conditions, the data protection regulations and the cancellation policy.
- Changes
The SELLER reserves the right to update these terms and conditions as needed. Changes will be communicated to CUSTOMERS in a timely manner and will only become effective with the CUSTOMER's consent.
- Contract text storage
The contract text is stored by the SELLER. The order details will be sent to the CUSTOMER separately in text form (email) no later than upon delivery. The terms and conditions can also be viewed and printed in the online shop at https://www.morenutrition.de/pages/agb .
- Right of withdrawal
The CUSTOMER has a right of withdrawal in accordance with the statutory provisions.
- End of the cancellation policy -
- Exclusion or premature expiry of the right of withdrawal
The right of withdrawal does not apply to distance contracts:
- for the supply of goods which are liable to deteriorate or expire rapidly;
- for the supply of sealed goods which are not suitable for return for reasons of health protection or hygiene if their seal has been removed after delivery;
- for the supply of goods if, after delivery, they have been inseparably mixed with other goods due to their nature.
- Note: Product returns
The goods should be returned, if possible, in their original packaging with all accessories and packaging components to Quality First GmbH c/o MBS Sports GmbH, Bukarester Str. 11, 93055 Regensburg, Germany . The SELLER requests the use of protective outer packaging to ensure adequate protection against potential transport damage if the original packaging is no longer available. Damage to or soiling of the returned item should be avoided. CUSTOMERS are requested to return physical products as a prepaid package to the SELLER and to retain the proof of postage. The CUSTOMER is responsible for the return shipping costs. The SELLER points out that the right of withdrawal and its consequences remain unaffected by this request; it merely serves to facilitate the return process.
- Prices and shipping costs
- The prices valid on the day of the order, as displayed in the online shop, apply.
- The prices displayed in the online shop are in euros and include statutory VAT.
- The purchase price is due immediately upon conclusion of the contract.
- When purchasing goods that are delivered by mail in a package or otherwise, the following applies: The prices displayed in the online shop do not include shipping costs for packaging and postage. Shipping costs are calculated dynamically during the ordering process and displayed in the shopping cart summary before the order is placed.
- Payment terms
The SELLER only accepts the payment methods offered during the ordering process in the online shop. These are:
- PayPal
- Credit cards: Visa, Mastercard, American Express
- eps transfer (Austria only)
- Apple Pay
- Google Pay
- Klarna
- Shop Pay
- iDeal (Netherlands only)
- The CUSTOMER selects their preferred payment method from among the available payment methods.
- PayPal: When paying via PayPal, the CUSTOMER must have a PayPal account and authenticate themselves with their PayPal login credentials. The CUSTOMER must then complete the PayPal payment process and confirm the payment to the SELLER. Payment via PayPal is also possible without a PayPal user account. The terms and conditions for PayPal's guest checkout function, accessible via the payment method, apply. If the CUSTOMER selects credit card payment in PayPal, they may be prompted for a second authentication factor, depending on the payment amount or the type of delivery, by being redirected to the credit card company's website. The CUSTOMER must then verify the payment process using their personal second authentication factor, such as password, PIN, TAN, or biometric data like fingerprint or facial scan, via a dedicated app.
- Credit Card: When a delivery is made against payment by credit card, the CUSTOMER, by providing their credit card details, authorizes the full invoice amount, including any applicable delivery and shipping costs, to be charged to the relevant credit card company upon the due date. At the end of the ordering process, the CUSTOMER will be prompted to enter their credit card number, the card's expiration date, and the security code (CVV) into the corresponding form. Depending on the payment amount or the type of delivery, the customer may be asked for a second authentication factor via a link to their credit card company's website. The CUSTOMER must then verify the payment transaction using their personal second authentication factor, such as a password, PIN, TAN, or biometric data like a fingerprint or facial scan, via a dedicated app. The specific type of authentication used depends on the respective payment service provider (e.g., the CUSTOMER's credit card company). In this case, the charge is initiated upon order confirmation.
- If a delivery is made against payment via eps transfer, the CUSTOMER needs an online banking account with one of the participating banks. At the end of the ordering process, the CUSTOMER selects the bank and logs into their private online banking area. There, the CUSTOMER checks the payment details already entered. If these are correct, the CUSTOMER authorizes the payment via eps and thus completes the purchase.
- When paying via instant bank transfer (Klarna Sofort) from the Klarna Group, the CUSTOMER must have an activated online banking account with PIN/TAN authentication. At the end of the order process, the CUSTOMER will be asked to enter their account number, bank code, PIN, and TAN into the form pre-filled by the SELLER (bank details, transfer amount, payment reference). The transaction will then be confirmed to the CUSTOMER immediately.
- When a delivery is made using Apple Pay, the CUSTOMER pays directly through their Apple account. After submitting the order, the CUSTOMER is redirected to Apple, where payment of the order amount can be authorized. As soon as the SELLER is notified of the authorization, the order is shipped – depending on the delivery time specified for the item. Depending on the payment method stored in Apple Pay, the account is charged either immediately after authorization or after shipment with the actual invoice amount after deduction of any discounts, gift cards, etc.
- When a delivery is made with payment via Google Pay, the CUSTOMER pays directly through their Google account. After submitting the order, the CUSTOMER is redirected to Google, where payment of the order amount can be authorized. As soon as the SELLER is informed of the authorization, the order is shipped – depending on the delivery time specified for the item. Depending on the payment method stored in Google Pay, the customer is charged the actual invoice amount, less any discounts, gift cards, etc., either immediately after authorization or after shipment.
- Daily100 subscription
The SELLER offers a limited number of subscriptions for the Daily100 product. The following special terms apply to these subscriptions:
- The maximum number of available subscriptions is initially limited to 5,000 customers and will be announced at the start of sales. Subsequently available slots may be reassigned on specific dates determined and communicated by the seller. The seller reserves the right to determine the number of subscription slots and the availability of waiting list slots at their sole discretion.
- Participating CUSTOMERS receive a monthly delivery of the Daily100 product consisting of 28 sachets.
- Payment is due at the beginning of each month. Participating customers may use the payment methods listed in section 9, with the exception of payment via Klarna.
- The subscription is for an indefinite period and has no minimum term. The notice period for cancellation is two weeks before the end of the respective month. If the participating customer does not cancel before the end of the respective month, the subscription will automatically renew indefinitely. The statutory right of withdrawal remains unaffected.
- Coupons, discounts and promotions
- Gift vouchers: These are vouchers that can be purchased by the CUSTOMER. The value of the voucher can be selected by the CUSTOMER from the options provided on the homepage. The value of the gift voucher can be applied to the entire shopping cart across multiple orders until it is completely used up. The validity period of gift vouchers is limited to three (3) years for purchases in Germany and five (5) years for purchases in Austria and Switzerland. To redeem a gift voucher, the voucher code is entered in the designated field before completing the order process. The corresponding amount will be deducted from the order total. Any remaining voucher balance is retained and can be redeemed in the next order by re-entering the voucher code as before. Orders exceeding the voucher value can be paid using the available payment methods.
- Gift vouchers: These are vouchers for a specific purchase value, issued exclusively by the SELLER to the CUSTOMER, e.g., as a courtesy. They are customer-specific, non-transferable, and cannot be purchased. Cash redemption is not possible. Gift vouchers are valid for one (1) year from the date of issue. To redeem a gift voucher, the voucher code is entered in the designated field before completing the order process. The voucher amount is deducted from the order total. Any remaining voucher balance is retained and can be redeemed during the next order by re-entering the voucher code. Orders exceeding the voucher value can be paid using the available payment methods.
- Product vouchers: These are vouchers for a specific product, issued exclusively by the SELLER to the CUSTOMER, e.g., as a courtesy. They are customer-specific, non-transferable, and cannot be purchased. Cash redemption is not possible. Product vouchers are valid for one (1) year from the date of issue. To redeem a product voucher, the voucher code is entered in the designated field before completing the order process. The corresponding product will be added to the order free of charge.
- Discount codes: By entering discount codes during the ordering process, the CUSTOMER receives a specific discount for the specified period on individual products, product groups, the quantity of products, the order, or shipping. Discount codes cannot be purchased but are issued by the SELLER with a specific validity period. Discount codes can be redeemed once in the shopping cart before completing the order. Retroactive application is not possible. Multiple discount codes cannot be combined, but combining discount codes with vouchers is possible during the ordering process. Discount codes cannot be combined with other discount codes. However, discount codes can be combined with gift vouchers.
- The minimum purchase value for gift promotions refers to the lowest value that must be reached after deducting any returns. If the minimum purchase value is not met due to a full or partial cancellation of the order, the gift must be returned to the seller.
- Deal-sharing platforms
The SELLER reserves the right to exclude BUYERS who are directly or indirectly associated with or actively use deal-sharing platforms from participating in promotions, challenges and advertising campaigns.
- Delivery and shipping conditions - Information on calculating the delivery date
- Unless otherwise agreed with the CUSTOMER, the goods, which are delivered in a package or by post, will be sent by post (parcel, package, letter, forwarding company, etc.) to the delivery address provided by the CUSTOMER in the order.
- The delivery time is specified separately for each item or in the product description on the item page.
- For payment methods where the CUSTOMER is charged directly upon placing the order, the SELLER will arrange delivery immediately upon receipt of payment. For all other payment methods, the delivery time specified on the product page begins on the working day following the date of the contract.
- Orders can be placed by all customers from the European Economic Area and, where applicable, by customers from other countries listed in the online shop and/or the shipping cost table. Delivery of orders is only available to Germany and the countries listed in the online shop and/or the shipping cost table.
- If the carrier returns the purchased item to the seller because delivery to the customer was not possible, the customer shall bear the costs of resending the item. This does not apply if the customer has exercised any existing right of withdrawal in conjunction with refusing acceptance, or if the customer is not responsible for the circumstances that led to the impossibility of delivery, or if the customer was temporarily prevented from accepting the offered service, unless the seller had notified the customer of the service a reasonable time in advance.
- Repayments
Any refunds will be automatically processed by the SELLER to the account used by the CUSTOMER for payment. For payments made by invoice, the refund will be issued to the account from which the payment was made. If the CUSTOMER paid via an external payment provider, the refund will be issued to the associated account. If the CUSTOMER used a gift voucher for their purchase, the corresponding amount will be credited to their gift voucher account.
- Retention of title
The SELLER retains ownership of the sold items until the purchase price has been paid in full.
- Warranty/Liability for Defects
In the event of defects in the purchased item, the CUSTOMER's rights against the SELLER are governed by the statutory provisions.
- Customer account
- The CUSTOMER can create a customer account free of charge in the online shop.
- When creating a customer account, the CUSTOMER is asked to provide their personal data in accordance with the SELLER's privacy policy. By providing their data, the CUSTOMER guarantees its authenticity and accuracy. They are also obligated to keep their data up to date in the event of an order. Additional shipping costs incurred by the SELLER due to incorrect or inaccurate data will be charged to the CUSTOMER. After requesting the creation of the customer account by clicking "Create," the CUSTOMER will receive an email.
- By clicking on the link contained therein, the CUSTOMER confirms his identity and receives confirmation of the creation of his customer account via e-mail.
- The CUSTOMER is entitled to register and operate only one customer account at a time. If the SELLER becomes aware of multiple registrations, the SELLER is entitled to exclude the CUSTOMER from using the online shop. CUSTOMERS whose customer account has been previously blocked or terminated by the SELLER may not create a new customer account. Minors are not permitted to register.
- Both the CUSTOMER and the SELLER may terminate the customer account agreement at any time with immediate effect for the future without giving reasons. The SELLER reserves the right to delete the registration of CUSTOMERS who have provided incomplete or incorrect information.
- Customer service
Any inquiries regarding an order can be submitted by customers or prospective customers via the Help Center. The customer or prospective customer can submit their inquiry using the Help Center's contact form and will subsequently be contacted by the seller via the email address provided in the contact form.
- Alternative Dispute Resolution
The SELLER is neither obligated nor willing to participate in dispute resolution proceedings before a consumer arbitration board.
- Final Provisions
- The law of the Federal Republic of Germany applies, excluding the UN Convention on Contracts for the International Sale of Goods.
- The foregoing choice of law shall only apply to the extent that it does not deprive the CUSTOMER of the protection afforded by mandatory provisions of the law of the State in which the CUSTOMER has his habitual residence.
